already at their highest levels already in the season in more than 30 years. good evening. i'm dan ashley. carolyn johnson has the night off. let's begin with abc7 meteorologist sand yaw patel. sandhya patel. she is tracking the rain. >> yes, dan, and the rain has made its way around many parts of the bay area. let's show you live doppler 7hd. let's go to the radar and we will show you what it looks i can like. we are tracking the storm around the monterey bay. let's show you where it is moderate around boulder creek and scots valley and summit road as you cansee here indicated by the yellows. we are seeing some moderate rainfall. and as i pan around to other parts of the bay area, you have to check this out. this is really interesting from cobb mountain to the hills surrounding ukiah and heading down or heading up depending on where you are. look at this, saint helena and we are seeing some pink here in the hills. it is an indication of a mix of rain and snow. of course we are getting the rain at the lower elevations around novato and santa rosa and tib by ron. as i take you down to stre

officer inside. i'm dan ashley. carolyn has the night off. we need this break from the rain as a chance to dry out, but the storms have certainly left a mark. we have live storm team coverage with meteorologist sandhya patel in a moment. first to abc7 news reporter leslie brinkley who has more on downed trees that have become a bad problem. >> it is a bad year for falling trees. the saturated soil and the lean lead to this one falling over. >> this arborist says the ground is super saturated, but what is toppling many of these trees is the wind. >> especially swirling winds that aren't coming from the standard direction can really cause a lot of damage. >> a huge tree came crashing down along dwight way and fell on to a passing berkeley police car driven by this officer. >> i heard a couple of loud cracking sounds and saw a couple of pedestrians pointing upward. a couple small branches fell and hit my view and hit the brakes. the abs activated and then a tree fell on top of the car. >> the officer walked away uninjured. the damaged car was towed. it was a similar scene across marin coun

us columnist and detail editor, dani henninger and kim strassel. dan, we like to say for a long time we live in a center-right country. if you look at the last two presidential elections that doesn't seem to be the case. are we living now in a new, progressive era? >> in terms of the presidency, i think we are, paul. i'm not sure about the country. barack obama i think is the center left or left wing president since the great depression and i think that what barack obama has in mind to do is indeed to redistribute income from the top downward, not to cut spending, but to increase spending, it's explicit from a 20% of gdp to 25% gdp and rather than cut spending raise taxes as necessary to support that spending and i would say that is in fact essentially the french model. and the question is whether it can support enough growth in the economy. >> paul: taxes are going up, we know that, spending, going up for sure even before the health care law kicks in. so, we are moving in that direction, particularly in the entitlement state. not reforming it, but actually expanding it. >> aen what

. volatility was a big deal in 2011. in 2012, not so much - until now. dan deming of stutland equities joins us this morning for chart talk. hi dan. what's happening with the vix? > > hey chuck. you are certainly seeing some strength there, some concerns as we roll toward the end of the year with no deal out of washington. you are seeing some vol buyers enter the market on a daily basis now. even though we have seen the market down the last five days after reaching a peak in the s&p of 1447. it is not down significantly, yet we are still seeing pretty active vol buyers, and you are seeing the vix up around that 19.5 level - it has not been there since july of this year. > we also had a quadruple witching day which has now passed. i expect that probably factored in a little bit. but do you expect less volatility now? > > actually it is hard to say. i think there are still going to be concerns as we roll in toward the beginning of the year. if there is no deal, i think you are going to continue to see vol buyers into january, because the expectations are the s&p could slip significantly if nothin

wanted to be late in the process. i'd been in the senate one day, and back in 1985, and dan inouye came to visit me in my office. he was up here, i was down here. and he just introduced himself, we talked a bit about our states, he had all kinds of seniority and, you know, amazing qualities. and i was nothing. and he came to see me. i'm sorry, but you don't forget things like that. says something about him which went through his life. just the way he was. from there, a long friendship began. and while i believed he looked at me as a friend, i looked to him as so much more than that. he was in a total sense a mentor with sort of a confucian touch because he had a japanese heritage and i had an interest in japan and he had a way of imparting judgments and wisdom which were in the eastern method, very subtle. he was not always that way, but he could be, and he was with me. i learned from him how this chamber works, how to get things done. i watched the way he did them. not with a heavy fist or sharp words, but with thoughtfulness, hard work, a commanding presence, that voice, that voice. a

the requirements based on what you just said for the military to consider putting him to death. but you know, dan, so does another case. we're not seeing this kind of movement on that one. i'm talking about the fort hood shootings and accused mass killer, main jar nidal hasan. he killed 13 americans on the army base in texas. it has been 2 1/2 years. will we see the death penalty against him? better question, will we see any charges against him? >> certainly he is being prosecute and there are court proceedings going on. there was just an appeal decision whether he can have a beard during his trial. he will be prosecuted for murder. if there is ever going to be a case where someone should be prosecuted and the death penalty is used this would certainly fit it. this is premeditated and calculated and you had multiple people killed. harris: we'll see what happens. they have a new judge and that will cause more delays. it is set to get going in february. we'll follow both cases with viewers. a quick topic change with you, dan. there is news breaking this morning. we're expecting a vote to come on th
